Chatbot “Sunny”- Terms & Conditions

The following terms and conditions ("Terms and Conditions") apply to the usage of Chatbot Sunny (“Sunny”) which is provided as part of the services by Sun Life Hong Kong Limited (Incorporated in Bermuda with limited liability) (“Sun Life”). You are deemed to have accepted and agreed to be bound by the Terms and Conditions by using Sunny.

  1.  The usage of Sunny is also subject to the legal notice, privacy statement, security information (where appliable) of Sun Life website ("Relevant Terms and Conditions").
  2. Sunny is an automated, interactive chatbot, powered by big data analytics, artificial intelligence technology to respond to your enquiries. The accuracy, relevance, adequacy and quality of the responses may vary with the evolving technologies.
  3.  The copyright in the materials of Sunny, including all text, information, graphics, animation, and images is owned by or licensed to Sun Life, or where provided by a third party, is owned by or licensed to that third party. You are permitted to use the materials for prescribed purposes approved by Sun Life only. All rights are reserved.
  4. Subject to the Terms and Condition and the Relevant Terms and Conditions, the information provided by you via Sunny will be collected, stored, used by Sun Life, or transferred to Sun Life authorised third parties, in order to improve the accuracy and quality of Sunny.  You acknowledge and consent to the recording of all communications via Sunny (including any documents or files shared, annotated and exchanged). We will also keep records of such communications in line with applicable legal and regulatory obligations and our internal policies. Sunny will not request you to provide any sensitive personal data during the conversation.   5. Your phone number will be retrieved via WhatsApp while using Sunny, which allows Sun Life to verify your identity. Only the existing advisors and brokers are allowed to access Sunny.
  6. Sunny is operated via WhatsApp thus the usage of Sunny is also subject to WhatsApp terms of services, including but not limited to legal notices, privacy policy ("WhatsApp Terms and Conditions"). For details, please refer to WhatsApp Terms and Conditions may be amended from time to time without prior notice and Sun Life will not inform you about the changes.
  7. Sun Life will not be liable for any matter or loss in relation to loss or any information transmission error due to technical problems of WhatsApp.
  8. We may use the recorded communications (or transcripts of any voice conversations made over Sunny) in any dispute and you agree not to challenge their validity, admissibility or enforceability on the basis that they are in electronic form. You agree that the recorded communications remain Sun Life’s property, and may be used for training, quality control and dispute handling purposes.
  9. Sunny is intended to provide service in Hong Kong and shall not be construed as an offer to sell or a solicitation to buy or provision of any products of Sun Life Hong Kong Limited outside Hong Kong.
  10. All information provided to you by Sunny is a product summary only and is provided to you for your reference only. You should refer to the respective product brochure and Policy Document for details including definitions, full terms and conditions, and exclusions. If there is any conflict between the Policy Document and this product summary, the Policy Document shall prevail.
  11. To the fullest extent permitted by appliable law, Sun Life shall not be liable for any loss or damage to you as a result of making available to you Sunny or any content of it (including without limitation any indirect, consequential or special loss or damage) even if Sun Life shall have been advised of the same, your use or attempted use of Sunny or any unauthorized access to your information through Sunny, unless such loss or damage is directly caused by our gross negligence or willful default.
  12. Sun Life reserves the right to suspend and terminate your access to and use of Sunny.
  13. You accept and acknowledge that any communications with Sunny and received by you pertaining to your enquiries/instructions may not be encrypted and may contain personal information and information pertaining to your accounts, and we shall not be responsible or liable to you for any possible release, loss or interception of such personal information and/or information.
  14. You are responsible for the security of your electronic equipment and the confidentiality of your information. You acknowledge that anyone with whom you share your electronic equipment or devices may be able to access the information provided by you to Sun Life via Sunny, including your conversation history. If for any reason Sunny is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, deficiency of service provided by WhatsApp or any other causes beyond the control of Sun Life that corrupt or affect the administration, security, fairness, integrity, or proper conduct of Sunny, Sun Life reserves the right, at its sole discretion, to terminate, modify, or suspend Sunny without prior notice.
  15. Sunny is intended to provide services in Hong Kong and the Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Sun Life and you agree to be subject to the exclusive jurisdiction of the Hong Kong courts.   Sun Life reserves the right to amend the Terms and Conditions without prior notice. In case of any dispute arising from the use of Sunny, the decision of Sun Life shall be final and conclusive.
